    So, you don’t think the Russians would triple tip to get nuclear secrets. They could even read them poolside while tanning. Those people are notoriously pale. Best of both worlds for them.

    For those whose brains have been turned to mush by right wing media:

    1. Trump could not declassify documents just by thinking about it. He had to follow a set process which would lead to the removal of markings on said documents.
    2. He still has no right to possess any of these documents as they belong to the National Archives not him. They are stolen property in his possession.
    3. He is plainly guilty of section 793(e) of the Espionage Act for possessing National Defense Information (classification is irrelevant) and refusing to return it when asked multiple times. This section could not be better written as perfectly describing what Trump did.

    We don’t know 3 yet. Based in public sourcing, We only know that property concerning defense secrets were on his property. We do not know “guilt.”

    Would have been more accurate if the sentence was phrased "appears to be guilty" although it's not an unreasonable inference given the description of the property in the affidavit.

    "FBI agents have already finished their examination of possibly privileged documents seized in an Aug. 8 search of Donald Trump’s Mar-a-Lago home, according to a Justice Department court filing Monday that could undercut the former president’s efforts to have a special master appointed to review the files.


    The “filter team” used by the Justice Department to sort through the documents and weed out any material that should not be reviewed by criminal investigators has completed its review, the brief filed by Justice Department prosecutors says. The filing came in response to a ruling Saturday by U.S. District Judge Aileen M. Cannon to hold a hearing this week on Trump’s motion seeking the appointment of a special master.


    The new government filing says prosecutors will provide more information later this week. But in the meantime, it notes that even before the judge’s weekend ruling, the filter team “identified a limited set of materials that potentially contain attorney-client privileged information, completed its review of those materials, and is in the process of following the procedures” of the search warrant to handle any privilege disputes.

    he will end up claiming ineffective counsel on appeal..this is comical. WOnder what the over/under is on how much of their fees will end up being paif vs written off to bad debt.


    Mar-a-Lago: Trump Hired Defense Lawyer After Seeing on TV, Says NYT (businessinsider.com)

    Renato Mariotti, a former longtime federal prosecutor, told Insider: "That's part of the reason why the former president has trouble finding lawyers: Because he demands that they file documents and take positions that have no legal support whatsoever."

    Trump's legal team also includes Evan Corcoran, also a former prosecutor; Christina Bobb, a former host on One America New Network; Lindsey Halligan, a Florida insurance lawyer; and Alina Habba, the former general counsel for a parking-garage firm.

    Corcoran is also said to have come into Trump's team in an unusual way. According to a recent Washington Post report, Trump hired him in a conference call without ever having met him.

    According to a source close to Trump, Corcoran was not vetted at all.

    essentially rendered meaningless since the FBI has already reviewed all the documents and set aside anything that might qualify for further review as privaledged

    Lindsey Graham predicting riots in the street if the great orange one is prosecuted..unreal. This guy needs to share the cell with Trump, hopefully the Georgia case brings Graham down too. I would hope that there would be massive protests if the evidence is there and the orange one isn't prosecuted. Amazing how much the pubs are trying to focus on Hunter Biden nonsense to divert attention away from the real crimes. Even here on this board there are MAGA defenders constantly trying to interject Hunter into the DT crimes discussion. I guess that's all they have left

    Amid growing fears about political violence in the US, a senior Republican senator predicted “riots in the streets” if Donald Trump is prosecuted for mishandling classified information.

    Graham said: “Most Republicans, including me, believe when it comes to Trump, there is no law. It’s all about getting him. There’s a double standard when it comes to Trump.”

    Alleging a failure by the FBI to investigate Hunter Biden, Joe Biden’s son, Graham added: “I’ll say this, if there’s a prosecution of Donald Trump for mishandling classified information, after the Clinton debacle … there’ll be riots in the streets.”

    Utterly irresponsible. Politically, Graham needs to avoid getting primaried to keep his seat. He has not chance to lose in South Carolina as the GOP nominee. Another example of how the GOP base drives this insanity. How minority rule works.

    It will be interesting to see what we can read in the government’s 40 page response. Presumably, there will be a “first filed” argument relating to why this judge should not hear this civil case at all. You just don’t have federal judges assume jurisdiction over matters in front of other federal judges and there is a federal judge already who reviews the magistrate’s rulings. The Trump team argues that Judge Cannon has “jurisdiction” because the magistrate cannot issue a civil injunction to preserve privilege. But Trump cited the Michael Cohen search warrant case, where an order concerning the appointment of a special master to raise privilege was issued in a search warrant case based on a motion. And there are strong cases addressing anti-injunction policies that interfere with prior filed federal cases. Especially civil injunctions in criminal cases and investigations. Judge Cannon entered her order before she even heard from the government in these or any issues. And we will see if the government alternatively addresses the merits of Tump’ filing.

    There's a separation of powers issue too about instituting a privilege Biden already waived. Not to mention Trump is trying to assert executive privilege which would only mean it's the Archives materials not his to keep anyway.

    Wheeler made a point on twitter that the DOJ requested the 40 pages because local rules only allow for 20. In that request, the DOJ takes note that trump's filing to Cannon last week was actually 21 pages, a trivial violation. I suspect they mentioned this to highlight that Cannon may be a bit bias toward her nominator.

    Between trump's request and Cannon's response, I'm glad an adult (the DOJ) is finally entering the party.

    Executive privilege, pfft..
