    Or he could sell the information to a foreign source. Based on his history I wouldn't put it past Trump to do whatever he can to enrich himself.

    Judge signals support for special master to review some Trump records FBI seized (msn.com)

    AFlorida federal judge Saturday indicated she was inclined to appoint a special master to review some of the documents the FBI seized earlier this month from former President Donald Trump’s Florida home as part of a national security-related criminal investigation.
    Trump’s legal team had filed the request Monday to have a court-appointed third party review the documents that the FBI took Aug. 8 from his Palm Beach estate, Mar-a-Lago. Trump’s representatives said the search was overly broad and that FBI agents carted off his passports and documents that were attorney-client privileged.

    If Cannon grants Trump's request, the special master would be in charge of reviewing documents for issues of privilege — not the highly sensitive records at the heart of the government's investigation. Trump's legal filing also sought protection for documents covered by executive privilege that applies to presidents, but since he's no longer in the White House, that legal protection does not automatically apply to these records.

    In her order, Judge Cannon instructed the Justice Department to file under seal “a more detailed Receipt for Property specifying all property seized” and she also required “a particularized notice indicating the status of Defendant’s review of the seized property, including any filter review conducted by the privilege review team and any dissemination of materials beyond the privilege review team.”

    An FBI’s "filter team" of agents — a group of agents independent of the overall investigation tasked with separating out documents attorney-client documents and those not relevant to the probe — has meanwhile been at work since the agency carted off the boxes of documents taken from Mar-a-Lago.

    This is going to be appealed to the 11th Circuit and quashed by that court. The earlier pending matter (the criminal matter has already exercised jurisdiction in this case. The decision to appoint a Master is up to the Judge in the pending case. There is plenty of law on this. Federal judges cannot interfere with the jurisdiction exercised by other federal judges. And there already is a judge to review Reinhardts decisions. There is no such thing as a civil injunction over a criminal matter in this context.

    Trump’s legal team should have requested appointment of a special master immediately upon completion of the raid instead of waiting two weeks.

    Even if he immediately argued for a “special master”, it wasn’t likely to change anything. The documents are what they are. A special master would likely make 99.99% of the same decisions as an FBI taint team would when reviewing the same documents.

    You obviously are not understanding the nuances of classified documents vs classified conversations. Classified conversations are not the verbal disclosure of classified documents. It is the utterance itself which is a classified conversation. So, when a president utters something of a classified nature, it becomes classified as soon as it leaves his mouth unless he simultaneously says “unclassified,” which then makes it not classified. Obama did not do this. On the other hand, when Trump told the Russian foreign minister that the Israelis had a spy imbedded within Al Qaeda, Trump simultaneously uttered “unclassified,” although it was hard to hear it. Each president as part of his training learns how to utter “unclassified “ while simultaneously saying something else. Obama and many other former presidents were not able to master this skill, but Trump was the best at it of any president ever. Biden often unintentionally utters “unclassified “ while saying something else, which is the primary reason for his speech problems, but that’s another story. Kudos to Rick for pointing out the nuances of classified conversations.

    Are you serious? You’re saying that a president can take a bunch of top secret documents that disclose where our nuclear assets are located and the names of our CIA spies and simply say that they are declassified, and he hasn’t committed a crime. And then, people can file FOIA requests and can get copies of those documents? I would like to see some support for that legal theory that doesn’t come from a moron.

    Look man, the only way anyone could get into that secure storage room by the pool was to rent a chaise lounge. That forces you to tip the cabana boy. And, if you want a chaise lounge and a top secret document, you have to triple his tip. Who’s going to do that?

    No. I didn’t miss anything. Obama’s conversation with Medvedev was not classified. All he said was that he would have more freedom to negotiate an arms treaty after the election.
