Good intent can likely keep him out of jail (and if its true that these docs were pulled from a padlocked pool closet that does not qualify), but ignorance of a law is not a valid reason to break it. @AzCatFan was mostly correct in his assertions (quoted below). Only "splitting hairs" corrections I'd make to the statement is that TS/SCI is the highest publicized form of classification the US has. Also, just because one has a clearance does not mean they are privy to data at their level of clearance. A "Need to Know" must be proven to exist. Without both components, the dissemination of classified information is considered a data spill.
What I said was that across the board "equal justice under law" is bullshit, not the DC area. As long as your guy is above the law it's all good. It is extremely rare for a judge to unseal an affidavit before charges are made. You seem to be a bit uninformed about the law generally and this investigation specifically.
