This and the next post touch on a precise issue. Even if Trump could declassify the documents and take them, on January 20, 2021 at noon, his powers expired. He could not keep them. The exceptions to the handling of classified documents under classification statutes and rules for a president no longer applies to him. They revert to their marked status. At that point, classification depended on Biden. And Trump could not keep them. As to the issue of Trump permanently declassifying the documents, whether he had it in his head and did it is purely a legal fact question. The failure to follow normal procedures renders this self evident.
Trump has no right to possess documents containing legal advice from government lawyers to the president in his capacity as president. They aren’t his personal documents and he doesn’t have a personal attorney client privilege outside of the presidency. If the docs concern his personal counsel, that is another issue. They will state they relied on the representations of their client. And they are entitled to disclose the reps that were made to them under ethics rules. There is an exception to privilege for self protection when the lawyer is accused of wrongdoing.
Accepting for arguments sake that these documents were declassified by fiat, one has to question tor competence of anyone for office who would declassify top secret SCI documents concerning nuclear weapons and payments to spies in our payroll without a rigorous review. Declassification means anyone can see it. The idea that Trump took nuclear codes to Mar a Lago (and he did that every time he left the Whitr House) Or documents concerning nuclear weapons, which meant that anyone could have access to the nuclear closed or anything else top secret, is laughably stupid. If that is the case, then he was grossly derelict and unfit of office. And once he became a private citizen, that was the standard for his mishandling information concerning national defense secrets
