Am I missing something? He wasn't plucked out by a District Attorney for criminal charges, was he? The reason he was in court is that one of the Sandy Hook families sued him. Is the judge really supposed to toss the lawsuit and tell the family "I'm sorry, you can't file a lawsuit against him unless you also file one against every person in the country who said anything potentially defamatory."
Can they really be that baffled by what has happened here, about why Jones was in court? I guess they can. I'm guessing Posobiec knows he's talking crap, but it stirs people up.

I'd thought the language surrounding his conversations with Stone was a bit odd. That explains it. Stone is pretty well known for this sort of thing.

Another exception to the First Amendment is defamation with actual malice. What he did was unspeakably cruel. And the results were what he knew would happen.
He maliciously lied about the Plaintiffs. The First Amendment doesn’t protect that speech. Fire in a Crowded theatre is another example. It is used to explain to lay people that the First Amendment doesn’t protect everything said. Like, for example, “I am going to kill your if you don’t give me money.” Or, “your children never existed and you are a method actor lying about your child being murdered.” Understand now?
Nobody is missing your point. You have no understanding of the First Amendment and are offering your amateur opinion of it, utterly divorced from well establish Supreme Court case law. Yep. Those actions, as damning as they were, were SOOOO last week. The past is the past...unless we are supposed to study it or else repeat it. If one hit and run driver hits a family 1000 miles from you and gets away with it, and another one causes harm to your family on your street, would you be ok with the argument that your family should suffer until the guy who hit the other family is charged? Of course there are missed cases, but we dont ignore others because of them. Alex Jones is a bad dude. He did evil things. He has to pay money. Congress didnt pass a law that can imprison him for what he said. He legally defamed with real harm. Thats it. 1A is not in play here under any accurate interpretation.
