Should medical decisions in emergency situations be made by doctors, or by politicians? Paxton and the Right are just jealous of doctors because they, unlike politicians, have a code of ethics.
I’ll have to read this - I haven’t had a chance to look at either the CMS guidance or Texas’s lawsuit. That said, I can at least see the argument that EMTALA is not a real great fit for dictating abortion availability in some circumstances (an EMTALA “emergency medical condition” seems like it’s potentially broader than the mother’s life being in danger, and I don’t know how many instances there would really be where an emergent abortion would be necessary “stabilizing care” at a facility that does not ordinarily offer abortions).
I was wondering if it was just the life of the mother or a broader circumstance that Texas takes issue with. I'll look forward to your perspective. I would say regardless, Texas (and every state) has to take the steps to protect the life of a mother, otherwise there is nothing pro life about their position.

I still need to read the Texas suit, but the CMS EMTALA guidance and HHS letter to providers are here: https://www.cms.gov/files/document/qso-22-22-hospitals.pdf https://www.hhs.gov/sites/default/files/emergency-medical-care-letter-to-health-care-providers.pdf For some context, EMTALA was adopted to prevent “patient dumping” - hospitals transferring uninsured or Medicaid patients (because they are unable to pay) who present in the emergency department to charity hospitals without first stabilizing them. It’s the law that has previously faced criticism for “allowing uninsured patients to use the emergency room as their primary care physician” since the emergency room has a legal obligation to evaluate them before turning them away. This is an interesting issue - although it seems fairly clear that the original purpose of EMTALA was not to force hospitals to offer services that violate state law, there’s probably an interesting argument to be had at least with respect to abortions that are necessary to save the mother’s life.
Just made a major move to Florida for our kids sake. Louisville just had to much going on so my wife and i chose to sacrifice for their future. Very positive move.
