how would you propose to apply this within the Constitution and our legal system?

 

The dad sounds like a pro-gun turd who perhaps had his mind poisoned by talk radio and Youtube (grooming? really?). His unapologetic words are borderline sociopathic IMO. Almost like he's more concerned for himself and already wants to just move on with his own life. So I guess the apple didn't fall far from the tree after-all.

Based on him signing off on this gun for his <21 son, a mere 2 months after this kid had a psychotic incident, I'd very much disagree on his "didn't do anything wrong" take. With such a parental sign off, should come some responsibility. Though the fact that the kid is NOW 21 I think might be barrier to criminal/civil responsibility. It would be reasonable to say that even if he didn't sign off on the gun back then, this 21 year old could have gone ahead and gotten it now. The bigger question would be why wasn't this kid red flagged. Is there a DUTY to red flag in his circumstance? There should be IMO. That should have been the barrier to entry. But we know the gun rights activists don't like these laws, and there's always a question of due process with a red flag (if you red flag this little psycho, how long would it last, 6 months, 1 year... how about 5 years... lifetime). At some point the gun rights activists will have none of it.

It's kind of amusing we have a couple of righties now claiming "duh, he should have been red flagged!", "Duh, he shouldn't be allowed to buy until 25!". I guess the dems can safely bring those restrictions to the floor and they should pass unanimously!

 

A little context on the shooter. Seemed to have progressed from counter protesting to harassment to intimidation to violence.

 

I get the sentiment and generally agree. However, I don’t see a path. Realistically, we can’t legislate our way to zero events absent draconian measures. No one will accept limitations on freedoms.

 

Oh, I agree there is no 100% safeguard. Look at the old guy in Las Vegas that committed a massacre out of nowhere. I don't recall there being any "red flags" there, at least not right until the moment that nut was transporting his arsenal up into his hotel room.

I do think raising the age to 21 would address a chunk of these shootings, since a bunch of the recent shooters were 18/19, almost all the school shooters seem to be in this age group. Unfortunately this kid was 21, and seemed highly motivated to commit mass murder, a true psychopath. So the 21 age limit on it's own wasn't likely going to stop him (if the dad didn't sign off when he was 20, this kid probably would have just bought when he was 21). The only thing stopping him would have been to declare him mentally ill, or for the father or someone to do their damn job and red-flag him and get him mental help (rather than crazily supporting his gun purchase). I thought even raising it to 21 was rather contentious policy, I just found it amusing conservatives on this thread are skipping right past that and going for 25 years (which will *never* happen).

 

Horrifying if true. But just as horrifying that everyone sees it, but everyone is scared to say anything.
