10 year old rape victim can't get abortion in Ohio

    Gladly. As Dr. Bernard practices in Indiana, please refer to Indiana Code 5-2, titled Standards of Professional Conduct. Specifically, refer to IC 5-2-2 Section 844, titled Confidentiality.

    I'll quote just a little of how it begins: "A practicioner shall maintain the confidentiality of all knowledge and information regarding a patient, including, but not limited to, the patient's diagnosis, treatment, or prognosis, and of all records relating thereto, about which the practicioner may learn or otherwise be informed during the course of, or as a result of, the patient - practicioner relationship.

    So, my statement about what she violated was incomplete: she also violated Indiana law.

    Disagree. Seems like a reasonable interpretation of that would be that the doctor would only be in violation if they identified the patent.

    And if we still don't know the identity of the patient, please explain how the doctor didn't maintain her confidentiality? All we know us she is a 10 year old girl from Ohio. Thousands of girls match that description.

    The IC section I quoted is titled "Confidentiality". It says "ALL information" and "including but NOT limited to...".

    I don't think the IC is ambiguous in any way. "All information" definitely includes the patient's age. And the IC certainly doesn't make any provision for talking to the press about anything involving a patient.

    If the story is true, this activist abortionist perpetrated a textbook violation of her Professional Standards. The only way she didn't is if her story is false. But that makes her a straight-up liar.

    But again, other than 10 year old girl from Ohio, we have no idea her identity. If I lived up all 5th grade girls from an elementary school, could you tell which girl was raped? If any were? No. So, her identity is protected.

    Doctors are allowed to talk about Patient X, and their diagnosis, as long as nobody can identify said patient. That's not a violation of HIPAA, or any state law that I know. If it were, doctors wouldn't be able to consult with others.

    You are engaging in a ridiculous interpretation of what "confidentiality" means. It means a person "knows the identity of a subject, but takes steps to protect that identity from being discovered by others". That's what the doctor did. Doctors share anonymous data all the time, in some cases, they are required to report it. If what you are saying is true, then a doctor would not able to share their experience and treatments with other doctors, even if done in an anonymous way. Seems like a stretch to even suggest that.

    You've missed the mark, my friend; no one is talking about consulting with another health professional, or even law enforcement. The IC clearly intends that medical confidentiality involves more than just name and age.

    The issue at hand is that this doctor initiated contact with a NEWSPAPER REPORTER for the purpose of either: disclosing the medical condition and upcoming abortion for a patient (as well as her age); or fabricating a story to support her abortion narrative.

    Neither is ethical. One is illegal, the other is dishonest.

    LOL… so now there are exceptions? Let me ask you this, has a heart surgeon ever been arrested or disciplined for telling some friends “I did a heart surgery on a 55 year old from Texas today”?

    Have you ever heard of a heart surgeon calling a newspaper reporter to inform them that they're going to do heart surgery on somebody?

    Where does the rule you quoted differentiate between telling a couple friends and telling a reporter? You are really reaching, here.

    Then lets try something a little more concrete than our hypothetical situations:

    Now that Biden has opened his mouth about it, national media are trying to confirm this story - without success. Dr. Bernard won't return calls, law enforcement in Ohio reports they don't know about any rape of a 10-year old, and even the WH press secretary admitted that they haven't checked out this story and that Joe used the story to make a political point. Snopes can't verify it, the NY Post calls it dubious, etc.

    Like I have been saying all week: this story is highly improbable. I don't think the source expected the backlash that is developing, and I suspect that she will eventually face professional consequences for what she said.

    If it's an artificial heart, yes. At least the first one.

    As for HIPAA, here's the link. Health professionals can't release individually identifiable information. Age and gender can't identify a person alone.

    Anyone thinking this passes the smell test is extremely biased. There is no police report of a rape, so this is fake news until someone produces a police report.

    What do you mean there are no police reports? Are you telling me there are no reports or investigations of sexual assault on a minor in Ohio over the last 2 months? I find that hard to believe. Only way that would be true is if the records are not made public, which may very well be the case.

    According to this, child protective services substantiates a claim a child sexual abuse every 9 nine minutes on average, with 34% of the victims being under 12. I find it impossible to believe this doesn't affect Ohio. Link?
