    That’s not surprising, Thomas has always written opinions taking the position that substantive due process is an erroneous legal fiction.

    In every substantive due process case he writes separately to say that, in his opinion, substantive due process isn’t a real thing, and that concurrence is him doing that in this case (and citing all the other times he has said it before).

    I don’t know that anyone else on the Court agrees with him on that point (as evidenced by no one joining his concurrence).

    We need one of those TH “republic” lectures about how, actually, governance is NOT based on the wishes of citizens, it is based on what a tiny portion of those people claim is best.

    Exactly. Even the majority of citizens in Mississippi (where this case originated) support abortion rights.

    So, no, these legislatures do not represent the will of the people.

    Funny it's only the libs that are getting their panties in a wad. Roe v Wade has been unconstitutional from day 1. You libs do know that each state already has for the most part their own abortion laws right?

    Different states had different laws about slavery, too.

    Plenty of Republicans are pro-choice, it’s not just libs.

    All of these cases should have been based on equal protection 50 years ago instead of an amorphous right to privacy that only exists in theory.

    Will take another 50 years for women to get their rights back, certainly not in my lifetime.

    We are going back to the future. I’m gonna go find my Pilgrim hat.

    And Barrett and Gorsuch are outright liars with no consequences for the crap they spewed at their confirmation hearings.
