Abortion bans will harm people who miscarry, too

The Supreme Court is poised to overturn Roe v. Wade this summer, as revealed by a leaked draft opinion released early last week by Politico. If the Supreme Court moves forward with its original opinion, access to abortion care will be curtailed in the U.S., but what many people may not realize is that people going through a miscarriage will also be affected.

When a pregnancy ends in miscarriage and the fetus is not expelled naturally, the pregnant person has three options: wait for their body to expel the pregnancy on its own (called “expectant management”); take medication, typically mifepristone and misoprostol (commonly called the abortion pill); or use surgical management, including dilation and curettage (D&C) and aspiration to remove the tissue from the uterus.

Some states could implement abortion bans that take the latter two options away from people experiencing miscarriage, as the medication and surgical procedures used are the same as those used for abortions.

“This places them at grave risk,” said Dr. Jen Villavicencio, the lead for equity transformation at the American College of Obstetricians and Gynecologists and an OB-GYN with a specialty in complex family planning. “No one facing a medical crisis should have to fear their physician pausing, or even halting, when in the midst of doing what the patient needs in order to resolve or avoid the threat of prosecution.”

 

Yep. And since you can't prove whether a miscarriage was natural or a botched abortion, doctors are scared of prosecution and not giving women help out of fear of being charged with murder.

That would seem to violate the standard of care for those women. How are doctors to proceed? Violate the law or violate ethical care? Something would have to be worked out. More oversight and documentation.

 

You think they care? These idiots think that an ectopic pregnancy can be reimplanted. All they'll see is a pregnancy was ended. There's no way for a woman to prove it was natural, so if she's given meds to finish the miscarriage, that doctor can lose his license & be jailed. It's already been happening in Texas.

The draft opinion tells you that they are taking away your rights. It says there is no right to privacy and a penumbras constitutional right. It says that the only rights recognized by the constitution are those originally contemplated when the constitution was first ratified. So, it does not reach situations and technologies not on existence originally. Even though the constitution speaks generally and not specifically. And if there was a law in existence when the constitution was first ratified, that law is valid even if the Supreme Court never passed on it. A BS doctrine to say the least, bit soon the be the law approved by the majority of the court. This is just the start. Abortion is the perfect issue because it has widespread condemnation from the religious right. So, you can get them to cheer the elimination of a right to privacy and adoption of originalism without understanding the consequences of that in all aspects of their lives. People here are even happy with the political consequences handed Disney for exercising speech. Because they disagree with Disney. The freedom to agree with power and the consequences of you disagree. All good for them. And on and on it goes.

Tennessee is another one of those states with laws that will kick in 30 days after Roe is overturned banning ALL abortions except to prevent death. No rape or incest exceptions.

In this country, a woman will now be forced to have her rapist's baby. If she gets an abortion she will go to jail and face a stiffer sentence than if her rapist just so happens to be charged and convicted.
