    how can a company keep in place a policy that has been ruled by SCOTUS as illegal?

    GOP states have “at will employment” and minimal worker protections, meaning a company can fire you or lay you off for any reason with zero cause, zero review, and zero recourse. Here is your 2 weeks pay, goodbye. I don’t think there is much legal case to sue a company for having a policy the govt required. Some companies may also keep these policies in place despite the govt being forced to revise it.

    Well for one, that is not at all what the Supreme Court determined. Companies can and do have mandates right now. The Supreme Court was deciding on the OSHA mandate. Keeping the health worker mandate, tossing the 100+ worker mandate. Companies can still do what they want.

    The policy itself isn't illegal. It's the government mandating it part that the SCOTUS ruled illegal. Think freedom of speech. You can go around spewing racist hate all over the place, and as long as you aren't inciting violence, the government can't do anything about it. But your employer can, and will likely fire you over it. For example, this former Merrill Lynch employee. Government can't prosecute for his speech, but ML can sure has heck fire him. Just like OSHA can't force a company to mandate vaccines, but if the company wants to adopt the policy anyway, it can.

    Yes I read it, thanks. :rolleyes: Question stands because folks were let go based on dates & guidelines that were struck down & now have been withdrawn. They're still being "strongly recommended" but that isn't the same thing.

    Company policy is that if you are not vaccinated, you have to wear a mask. There is no vaccine requirement. Policy applies to all employees and visitors. Exceptions are if you are working outside and not around other people or in an office by yourself.

    The employee refused to comply with the policy and resigned.

    Lol, now you're naming a specific type of mask. Thanks for admitting that the experts that you and others blindly followed were wrong with the mask mandates.
    It's amazing how many are still catching covid with wearing these types of masks that have had at least 2 to 3 jabs of the magical vaccine, so either the mask doesn't work, the vaccine or could it be that neither are really that effective

    Many employers are going to keep the mandate for employees. It is fact of life. Just as TB tests and flu shots are already fact of life for health care employees. Just has hepatitis and other shots are required by my employer for me to travel overseas. This is no different.

    Airlines, cruise lines and many other businesses that require high levels of public interaction will certainly keep it. Some companies are asking for vaccine status, and if you do not prove you are vaccinated you will need to wear a mask indefinitely. If you choose not to wear the mask at all times at work, you will be dismissed.

    Employers are going to continue to do this because they are realizing that reducing lost worker hours due to illness is a positive. They are going to continue to do it because the first time someone gets seriously ill from a workplace exposure, they are going to sue the employer for not creating a safe working environment. In general, employers are going to keep it because it covers their arse.

    Hope you did not lose a good employee.

    I will say the fact that employers are using vaccination status to determine mask protocol is illogical with omicron. And that is not even addressing the reality masks do not work (assuming N95s are not required). The vaccinated spread this thing just like the unvaccinated. A logical policy if a company believes the mask works is for everyone regardless of vaccination status to wear one. If someone got omicron they are good with their natural immunity. Delta natural immunity. Maybe. Alpha natural immunity. Probably better than vaccination but omicron does not care.

    And vaccinations do not with omicron. Mask policies based on vaccination status are illogical.

    I will say alpha has lost some of its grip with omicron. Not sure on delta. But omicron Natural Immunity is going to be by far the best.

    LOL! Losing workers to being sick by requiring a vaccine that is doing absolutely nothing to slow the spread.

    We need to stop with the now 5 day quarantine. If you are better…people should get back to work. If you are sick…stay home. But the all knowing cdc….:cool:
