    Trump's use of executive privilege will test congressional power to enforce subpoenas

    I'm certainly no lawyer, but the question occurs that if congressional subpoenas can be ignored with impunity, what about potential challenges to subpoenas in other venues? (that who equal protection thing) It also renders a co equal branch of government irrelevant and impotent when it comes to oversight and any semblance of accountability in the executive branch. Just because people you happen to agree with get away with it does not make it ok.

    It’s not really a coequal branch of government anymore. The Presidency is now vested in Biden and he has not challenged the subpoenas. In fact, his DOJ may be enforcing them.

    It’s far less of a branch battle now. It’s really about what, if any, authority a former President maintains in this circumstance over their former employees and papers.

    My understanding is that the purpose of executive privilege is so the President can get candid and opposing points of view expressed to him with no fear of it becoming public. If that ends when the President leaves office why would someone give him an unpopular point of view?

    Go back to Truman and the decision to drop the bomb on Japan. Maybe not everyone advising the President wanted their opinion known by the general public, but if the President asked for your opinion, I would think you would give it. After Eisenhower was elected, those conversations with Truman were not made public, at least not for many years.

    You are seriously comparing Trumps criminal insurrection conspiring to the deliberations over dropping the nuclear bomb?

    Not everything a President does is legally privileged. Things that are outside the scope and duties of the President definitely aren’t subject to executive privilege, that applies to a political campaign. Crimes can’t be hidden behind privilege anymore than an attorney can cite attorney-client privilege to hide behind their own criminal acts. Privilege goes out the window if you conspire in criminal acts. There’s a few people that could theoretically claim executive privilege (perhaps those working in govt at the time who were meeting with “President” Trump in an official capacity.). But the thing is even for them it is now up to the current President, the current executive branch, to claim the privilege or not. Private citizens don’t get claims of executive branch powers.

    Two cousins with extensive criminal records were sentenced Wednesday to 45 days in jail for storming the US Capitol during the pro-Trump insurrection on January 6.

    Their criminal records factored into Chutkan's decision to send them to jail. Hemenway spent five years in prison for sexually assaulting and illegally detaining a woman in 2006. Bauer has several drug convictions dating back to 1999, though he has been sober for the last 15 years.
