    I'm sure this has probably been asked before but if there was an insurrection why has nobody been charged with the crime of insurrection?

    Maybe they are saving that charge for the worst of them, and the organizers and militia types?

    For the people who are cooperating or pleading guilty, they obviously aren't going to add maximum charges. But there’s no reason it shouldn’t be on the table if a person wants to drag it out all the way, particularly if there is evidence that person planned to attack the capitol (thereby negating the “defense” of it being a mere spontaneous riot, just a bunch of people out for a stroll on a random Wednesday who spontaneously decided to wreck stuff).

    Insurrection charges require violence. Sedition and conspiracy do not, which is why most of the current charges are trespassing and sedition. The insurrection charges will come to those who were the most violent. Here's a good link explaining the difference between the charges.

    Pretty much. I didn’t even realize anyone was actually charged with “sedition” yet either. But clearly all of these charges apply to some if the govt wanted to really throw the book at them, the elements of the crime are all there.

    His question is basically like: lol no collusion, where’s the collusion? I only see a bunch of conspiracy against the United States charges!

    Dumb thought of course but when folks were breaking and entering into the capital, no one thought there would be consequences? DT does not seem to be paying many legal bills for the followers.

    Mainly because AG Garland wants federal prosecutors to use obstruction of congress and conspiracy laws rather than the more politically charged sedition. Such charges carry similar penalties as sedition and/or insurrection.
