    The most amazing thing with Republicans here, is their concern over the bi-partisan commission being politicized. Talk about a projection! Hello McFly... these were the people that brought us like 14 politicized Benghazi investigations. 1 would have sufficed. On this attack, apparently they don't want 1 bi-partisan commission.

    It was nice of him to wear that easily identifiable green on his jacket, really stands out in all the video/photo evidence.

    In case you are wondering, this is a bad argument.


    Why? Because literalism isn’t the inquiry. The inquiry is likelihood to cause imminent lawless action. A statement doesn’t have to be literal to satisfy that likelihood standard.

    I will give an example to prove the point. Let’s say a KKK leader is whipping up a crowd of racists and there are reporters there, one of which is Black. The KKK leader then says, “We need to rip off those n-‘s heads and s—-down their necks! And we need to start with HIM!,” pointing at the Black reporter.

    Is his statement *literal*? No. He doesn’t mean for the crowd to literally tear off the reporters head and defecate on his neck. He means that they need to violently attack him.

    Is the statement likely to cause imminent lawless action? YES. So it is not protected by the 1A, despite its lack of literalism.

    And now the Senate GOP has blocked an independent commission via Senate filibuster. What an embarrassment.

    Not surprising. Although Mitch McConnell almost certainly despises Trump my guess is that he showed fealty to the Dear Leader after Trump threatened to remove him from his leadership position in the Senate the way he had Liz Cheney removed from her position in the House.

    I don't think it is loyalty to DT so much as deference to Republican voters. They are largely pro-insurrection, or at least not anti-insurrection

    Mitch won't be running for reelection until 2026 if he decides to run again at all so as far as he is personally concerned being primaried by Republican voters in Kentucky really isn't an issue. Although obvious speculation, an independent commission is a major issue for Trump since a finding that he was complicit in the insurrection could hurt him among swing voters. If a congressional committee or committees find him complicit he could dismiss their finding(s) to a partisan witch hunt not so with an independent commission. In a way Trump and the majority of Republican voters cannot really be separated since the latter are extremely deferential to the former. Should Trump turn on Mitch and decides that he should no longer be in a senate leadership position he would use his influence among party's rank and file voters by threatening to primary any Republican senators who refuse to go along with him. In the end when Trump says jump Mitch McConnell as well as Kevin McCarthy in the House will respond with the question "how high?".

    You could be correct. I felt certain when I post that earlier. I am now listening to Ezra Klein discussed the fact that you can't say anything that upsets Donald Trump, and that Liz Cheney's primary sin was to keep talking about January 6, when they all just want to pretend it didn't happen.

    I do think the base is pro doing whatever it takes to take/keep power, democracy bedamned if it stands in the way

    You realize that the GOP used the filibuster to stop the investigation of a mass violent crime with police victims and assault on our democracy? Spare me your crocodile tears for law enforcement.
