Yeah, but they didn't refer to it as "The Yeti" or some other mythical beast, so I am only 50/50 on the efficacy of this suit.
Dominion Voting Sues Former Trump Lawyer, Seeking More Than $1.3 Billion In Damages More Trump supporters making America great again in quotes from the complaint: "We're going to blow your f***ing building up," one person said in a voicemail left on the Dominion main office line, according to the suit. One employee, Eric Coomer, spoke to Colorado Public Radio from an undisclosed location last month after he was forced to leave his home due to the threats. -------- More suits to come against Fox etc. for spreading lies that have destroyed a company and 300 employees livelihoods with no basis and for the sole purpose of trying to steal an election. The good news is our courts worked in denying Trump's unsupported claims of election fraud and will hopefully compensate these companies that have been wrongfully devastated by the team Trump lies.
So how does it work? Can they just settle to avoid being deposed or going through discovery (<== I am already on the ledge with my TV law degree)? If Dominion doesn't want to settle, what happens if Fox just refuses to cooperate/participate?
As far as settlement is concerned Dominion is in the driver's seat. It's the plaintiff who has the final say when it comes to a settlement. Still predicting a settlement that includes a very strong retraction of the baseless allegations against Dominion and sufficient monetary damages to make the defendant(s) feel some pain. If the defendants refuse to cooperate insofar as discovery is concerned there is always the time honored remedy of contempt.
Dominion's business model may be changing and dropping it's less profitable group that manufactures voting machines and ramping up its legal redress division that promises to be more profitable* *assuming they ever collect a penny to which they are entitled
That’s about as strong a retraction and apology as you can issue. No hedging, just admitting that everything they said about the company was completely false. maybe they had a moment of clarity and responsibility. Or maybe they realized that they didn’t have a chance in hell in court.
It becomes an additional claim if you do. Spoilation of evidence. And it stops them from destroying documents as part of their standard document disposal methods.
I find comments like this so depressing, as it demonstrates the utter ignorance some people have in the American justice system. Many of Trump’s suits were dismissed for lack of standing. Standing is a jurisdictional requirement—and a conservative one in its present form. It is required for there to be a case or controversy so courts are issuing advisory opinions. It requires that the person suing show they were injured. That the injury is fairly traceable to the person they are suing. And that the person they are suing is capable of redressing those injuries. It’s not a technicality. It is an absolutely necessary part of any suit. If you don’t like it, your beef lies with Justice Scalia, who is largely responsible for how standing functions now.
A judge doesn’t let the defendant just “not participate”, unless the case is dismissed. If discovery is ordered they may be able to challenge it, but at the end of the day it’s up to a judge.
Seems that the Dominion lawsuit may already be having an impact. Rudy Giuliani and Sidney Powell have disappeared from Fox airwaves Don't know if anyone has picked up on the irony, Lin Wood will most likely also be sued by Dominion for defamation. Wood represented Nick Sandmann in his suit against CNN and the other media outlets and managed to extract a settlement from CNN, probably in the $500,000 range, on behalf of his client. In the end Wood will probably end up paying much more to Dominion that CNN paid to Sandmann.
I am pretty sure they would be presumed guilty in the court of law and pay heavily. Not participating is the same as declaring I am guilty as charged.
I can't really think of a better example of an winnable, high damages defamation case. Almost no one knew the name "Dominion" before right wing pundits started peddling lies about them. I certainly didn't. Now their business is likely ruined, since in the ballot counting world the Public's perception of accuracy is at least as important as a company's actual accuracy. There's pretty much no doubt that Dominion is going to lose a huge portion of its business, simply because counties/states don't want to deal with uninformed loons complaining about "fraudulent Dominion machines." Then you have the outlets continuing to publish these false stories, despite authoritative sources saying they are bunk and state wide hand audits confirming that the Dominion machines were producing accurate counts. Not only will truth not be a defense, it will prove the defendants' wrongdoing. You're going to see more folks dropping to their hands and knees begging not to be sued.
