    I don’t understand. How would this not return a guilty verdict? We have a hate crime caught on tape. How would a jury in good conscience possibly move to acquit these two men?

    You never know about a jury. Casey Anthony and O.J. Simpson come to mind.

    Fair enough, but Casey and O.J. weren’t on video tape. I don’t think any responsible prosecutor would offer a plea deal for such a heinous crime that was caught on film. There would have to be something else present, like mitigating circumstances or something like that.

    Not really--I think Phil is right--Prosecutor wants to bury this shit ASAP.

    It's a no win situation really.

    Even winning at trial will ever be tainted for delay in moving forward and seeking to prosecute.

    The more convincingly they win, the more they make the initial balking look like a 'good ol' boy cover up', that was exposed...

    ...and of course, if they lose, cue up the riots...Atlanta will burn again....

    I'm no attorney and you could very well be correct. Still, going to trial always has some element of doubt to it. If they plea to a lesser charge it may not make everyone happy but it guarantees a conviction.

    Since when is the criminal code divided in percentage of culpability???

    You're either guilty, or not.

    Save the percentage analysis for the wrongful death tort action, where comparative/contributory negligence might come into play, depending on GA law.

    Of course my original take--that God forbid, the defenses actually asserted should be vetted (which actually happened before the arrests) was met with the same paranoid panicked PC mindless reactionary spasms....

    ...and I remind....

    The decedent actually attacked the guy with the gun, when he was far from cornered.

    If this thing doesn't plea out, bank on hearing the Defense team beat that like a drum, in super slow-mo, a few dozen...nay, thousand..times....

    It assumes nothing.

    The SAO will huff and puff and bluff his/her ass off, and threaten everything from the DP to going after his/their grandchildren until the last is locked up, to sweetening the deal however s/he can, to ... *persuade* the Defendants to take a plea.

    IF the D's force this thing to trial, they better win--it's all or nothing if it goes to trial, and I'm not talking about the DP.

    Their families will be hounded from here to hell, with today's self-righteous neo-progs, who damn near mirror the lynch mobs of yesteryear in their vitriol, each trying to out PC the next guy...

    This is just pure speculation on my part, but who goes after a man pointing a rifle at them with his bare fists, if he can run the other way? Is it possible Arbery was high on drugs or inebriated in some way? McMichael could have easily taken a shot as he was coming towards him, but did not. That took some restraint and isn’t indicative of someone seeking to murder. In any event, that took some balls on Arbery’s part. That just doesn’t seem like a natural reaction to take when you have a gun pointing at you and you’re unarmed.
