    Just something else to consider. Maybe he did go in or look in the house under construction for other reasons then theft.

    I base what I wrote on the introduction of doubt. Not even sure if that could be done but based on a trial I was a juror on the defense introduced some doubt as to whether a person was actually trying to steal something when a homeowner and his son caught the man trying to get into his truck at night. The truck was unlocked and the charge was attempted burglary but he claimed he was climbing up into the truck to sleep. Bottom line there was enough doubt that we returned an innocent verdict even though I personally thought he was trying to steal a toolbox that was on the floorboard of the truck.

    Ridiculous. The jogger (who was under obvious threat) was defending himself against an armed man. Terrible abuse of the self-defense defense.

    You're saying that anyone who defends themselves against a gun, knife, or whatever, is at fault if they try to disarm their assailant, and the actual killer skates on self-defense. Have I got that right?

    So in Georgia, the only thing you need to hunt down and kill a black man is a positive ID that the black man is a suspect in a crime? Is this the path you want to go down, @92gator? That the two men who hunted down Arbery were justified in chasing him and attempting a citizen's arrest because Arbery was positively identified for a crime that the father didn't even witness happening himself?

    If the Dad didn't witness Arbery or anyone matching his description committing the crime, where's the evidence that the Dad is using to make a positive identification? Wouldn't that be an important piece of the puzzle? Sure, the two white guys saw Arbery running in the neighborhood before and looking into an unoccupied house under construction, but that's not witnessing a felony crime. If this is what the white guys are using for positive ID then they had zero legal justification for pursuing Arbory and attempt a citizen's arrest.

    A false citizen's arrest is a crime. And in the act of attempting to a false citizen arrest, Arbory died. That's murder.

    Let the guys have their day in court, but how this is anything more than a man being shot because he was jogging while black, I simply can't see it.

    Actually, as far as I can tell, there is no evidence of a crime ever being committed, witnessed by them or otherwise.

    I didn’t watch the video. I’ve been to numerous murders and don’t care to watch a real one on video. I don’t watch videos when the news person says the following video is graphic. That’s why I said I’m not making any judgements.

    I’ve put too many fire death victims, some murdered, some accidental, and some children into the big black bags for the coroner. Some of the adults were murdered before they were burned. It bothers me to watch it and brings back bad memories.

    Outside looking in it looks like a murder. Until all the circumstances and evidence is available, no one can say for sure where it falls under Georgia statue.

    So,,,,

    Once again,,, they should have called the police right away and following the guy until they saw where he was going and let the police handle it. What they did was stupid, really stupid, and now a man is dead over some stolen items that he may not have stolen. And the stalkers are going to do time or at least be sued to hell and back.

    I feel bad for the deceased and his family even if he stole the items. It shouldn’t be a death sentence.

    Born and raised in Ga. Worked in rural areas of S. Georgia. I am painfully aware of the double standard. It is so ingrained in some that sometimes it passes as ordinary and normal in some places.

    Ok, but what immediate knowledge do any of them possess? They didn't witness a crime. Assuming there was a prior burglary, neither knew Arbery was the burglar. They were working on speculation, not knowledge.

    That does not put it squarely within the statute. You need to reread it. The second sentence matters just as much as the first sentence.

    911 calls:

    Arbery had been seen recently on surveillance video in the neighborhood, according to the first caller. Neither call specifies a crime Arbery might have committed.

    “There’s a guy in the house right now; it’s under construction,” the man told the dispatcher.

    The man then gave her an address.

    “And you said someone’s breaking into it right now?” the dispatcher asked.

    “No,” the man replied, “it’s all open. It’s under construction … “

    The man interrupted to say Arbery was leaving. “And there he goes right now.”


    “Ok,” the dispatcher said, “What is he doing?”

    “He’s running down the street,” the man said. The next sentence is garbled.

    “That’s fine,” the dispatcher said. “I’ll get (police) out there. I just need to know what he was doing wrong. Was he just on the premises and not supposed to be?”

    The next sentence is garbled. “And he’s been caught on camera a bunch at night. It’s kind of an ongoing thing. The man building the house has got heart issues. I think he’s not going to finish it.”

    “Ok, that’s fine,” the dispatcher said. “And you said he was a male in a black T-shirt?”

    “White T-shirt,” the man said. “Black guy, white T-shirt. He’s done run into the neighborhood again.”

    The next 911 call from Satilla Shores came in at 1:14 p.m.

    “I’m out here at Satilla Shores,” the man said. “There’s a black male running down the street.”

    “Where at Satilla Shores?” the dispatcher asked.

    “I don’t know what street we’re on,” the man replied.

    “Stop!” he can be heard shouting. “Watch that. Stop, damn it! Stop!”

    That call went blank for several minutes, with the dispatcher trying several times to reach the caller. The call eventually hangs up.

    If I’m a black guy in the rural South and
    * a white guy in a pickup chases me down, and
    * he and his buddies are armed & ready
    I’m either going to find a way to split or go down fighting...maybe even the latter as a first resort if I’m just PO’d of things I’ve had to endure.

    I don't doubt the incredible difficulty of a cop's job or your sincerity. No one appreciates cops more than I do. But, first, why do you chime in when you haven't even seen the video? THAT is what outrages so many here. Sometimes, as here, the "experienced voice of reason" grates. Second, why say "even if he stole the items"? That grates, too. There were no items in his possession, so why even entertain the thought he may have stolen something?

    This is at least as egregious as the incident a number of years ago where a cop in racially tolerant South Carolina pulled a black man over on a traffic stop and, when the guy took off running, shot him in the back and killed him. He was convicted of manslaughter. Here, it may well be murder because two citizens with guns lying in wait for an unarmed man reeks of premeditation.

    Raised in North Florida. All of my ancestors are from Alabama and Mississippi. Fortunately, my 3 siblings and I had parents one would today label - gasp - libertards!

    Im camping out in the sticks of Georgia...I see Stanley Pedophile getting ready to get in a car, to go who knows where...

    I never saw S'ped molest a kid, but upon information and belief, believe he's wanted.

    I tackle him, effect a citizen's arrest.

    I do not fall within the statute bc i never actually saw S'Ped molest a kid, and he wasn't molesting a kid when i arrested him.

    Do I understand you correctly counselor?

    Fair point.

    But that was the claimed basis--needs to be vetted. If the claim fails, so does citizens arrest.

    Next issue, which has its own separate analysis, especially if CA fails:

    Does the kid/shooter's actions amount to MS/homicide, or does it still fall within self defense?
