Based on the logic of those rednecks, we can go to Brunswick, wait for them to leave their houses, chase them down, try to make a citizen's arrest for the murder of Ahmaud Arbery, and kill them if they resist.

Murder won't be easy, but manslaughter should be.

    Certainly.

...and if the decedent had killed the shooter, he'd have a slam dunk defense, imo.

    But it works both ways.

Since he attacked the shooter, the shooter gets to argue self defense.

That's what I was thinking. If any charges are brought, manslaughter would be the one most likely to result in a guilty verdict IMO.

There are two standards for blacks at play here, depending on whose ox is being gored: either “he matched the description” or “they all look the same”.

Yeah, I'd bring both. This seems like an appropriate case for it. I wouldn't go all in on murder, especially not in Brunswick, GA.

Immediate does not refer to the crime, but to the private person's knowlege.

IOW, the PP has to have immediate knowledge, not second or third hand.

(The question that presents, is whether the dad's knowledge-assuming it can be established/maintained--can be imputed to the shooter, since both were involved in the attempted citizens arrest...).

He fit the description caused them to arm themselves and pursue the guy. How much liability (%) would assign to the posse and how much to the guy who, in his mind, was defending himself against the armed duo?

Presumably, that the dad identified him as the perp of other break ins.

That was my first thought when I viewed it the first time: who the hell is videoing it and, more importantly, WHY???

Except there's no indication that they had any idea who took the gun. It doesn't sound like he even saw the person do it.

And these men could’ve controlled their urge to stalk Arbery, called the police and let the police do their job. Which is what any rational minded person would’ve done.

Just to be clear because everyone is making claims. and there are mixed reports.

The only break in reported was that McMichael says he saw Arbery coming out of a house under construction and that he wanted to question him, so he grabbed his son to stop Abery.

So, no burglaries of this house under construction had EVER even been reported. & when they talk about him matching the description of someone on a surveillance camera, what does that even mean? Any asshole can put up a camera. Seems the killers may want to release this footage. But, if there was any video footage of this guy committing a crime, why to this day has no crime been reported?

The bottom line is simple...you have to OBSERVE a crime being comitted to make a "citizens" arrest...they did NOT observe a crime being comitted...these are red-neck racists who just wanted to kill a...well...you fill in the rest.

It sounds to me like they saw him in the neighborhood on surveillance cameras and thought him suspicious. But that's not a crime. It has only gotten more and more apparent that they had no justification for trying to arrest him. Shame on that Barnwell clown who tried to let them off the hook.
