I actually just remembered this email while perusing Twitter:

If Kavanaugh doesn't recall the game of dice where he grew "aggressive," doesn't that contradict his claim of never being blackout drunk? Did he limit it to only high school and college, or did he say in his life?

It should, but I'm very skeptical of this. Look at this board. It's littered with comments about the illegitimacy of the Russia probe, and Guiliani has already said they are going to release a report at the same time, so that the people can decide. As if these two reports would be equally legitimate.

A job interview vs prosecution are two very different things. Govt routinely does extensive background checks on many people applying for particular positions, and these are often entry level in which their history back to their younger years is part of it. Indeed, often picked apart.

And sometimes, something they did long ago disqualifies them. Or if they lie, they're done.

But go on with the constant outrage...if it makes you feel better.

I got to chat with the FBI once when a buddy and neighborhood friend I knew in middle and high school and had not seen in years was selected to be one of the Marines on duty at the White House. About all I could tell them was he was poor at basketball.

I've been involved with hundreds of background checks. Nice try.

If you were interviewing for a job and during the course of the interview it came out that you had been accused of a sexual assault that occurred while you were in high school, any company worth a damn would consider quotes in your yearbook that might lend credence to the accusation. To do otherwise would be ridiculously stupid on the company's part.

Why would somebody want to protect their family from death threats? Crazy talk. I know.

Speaking of excuses... and crazy... what's the latest on why it's okay for somebody nominated for the highest court in the land to repeatedly commit perjury and go off on a crazy partisan rant?

The issue here is that the FBI is no going to make any determination with regard to this matter. They will take statements from witnesses, most likely delivered through their lawyers due to the publicity of this nomination and the use of lying to the FBI as a chargeable offense recently, and then deliver it up to the JC. They won't say, we believe X is more credible than Y, especially if they can only ask questions through lawyers. This is why FBI background investigations are done quietly and specifics are limited on what the FBI is asking questions about. We are now in a position that partisans on both sides are in a position to answer questions in a way that favor the outcome of their political persuasions.

That's the exact opposite of what's being done.

My polygraph was taken when I was about 2 years out of college, a year or two after Brett's alleged party habits. The exam included what party habits I indulged in as a crazy college student of the early 80's, and I told the truth. Now to be fair, my party escapades did not reach the lofty standards that Brett and Da Boyz set, but enough to shock a guy the age of the examiner.

I was offered the job. Apparently, they valued truth over party fouls by a young college boy.

Only a terrible lawyer will allow their client to be interviewed by the FBI under the penalty of being charged with lying to the FBI, when the FBI lacks subpoena power. Everyone mentioned as being at the party by Dr. Ford has lawyer-ed up. Those lawyers are going to want to know the questions the FBI wants to ask in writing and then likely provide written answers to minimize any legal exposure.

Without divulging any confidential information, they kind of fell along the lines of a popular song at the time.

He stated the hypothetical as Mueller indicting Trump for all sorts of illegalities. If that actually happened, Trump may well maintain some fringe support. Hell, even Nixon did. But the overwhelming call would be for Trump to step down.

Though this is just a useless exercise, because if Mueller actually had a shred of evidence showing that Trump committed treason, he would not wait, due to the national security implications of having someone like that in the Oval Office.

All three of the accusers, Kavanaugh, Judge, Keyser, and Smyth have all said that they will cooperate with the FBI. I guess they all have terrible lawyers.

Got that, ty. My response to jersey was about his taking issue with Senators/public having looked to BK's hs yearbook in response to the allegations against him. This would not be extraordinary in non-high profile situations where there is no media spotlight and it shouldn't be now under the circumstances.

If the FBI comes up with nothing more than we already know, Kavanaugh is still guilty of perjury.

What does the word "cooperate" mean to you?

I think "cooperate" falls well in the scenario I laid out. "I'll cooperate with the FBI, as long as the FBI gives my lawyer a list of questions that they want answered and allow me to answer them in written form."

Well, I'm not sure. For one, Mueller won't indict Trump no matter what he finds. In fact, my best guess is that Mueller won't release any kind of final report at all. He will just give to the DOJ a report on the findings, with maybe some recommendations on how to proceed. Two, the most serious charge that Mueller would recommend would be conspiracy, which is difficult to understand. He could find some less provocative campaign violations, but with both of these things, the Trump team would try to win the public relations battle. Even Nixon wasn't going to get impeached 100-0.

As for whether Mueller has a shred of evidence, I would argue that he almost definitely does, or he would have shut down the investigation by now. However, a good investigator won't ever push a charge without having every claim backed up by evidence, so I'd guess that's where the investigation is now. A good chance it ends there, because shreds of evidence won't cause people like Mueller to recommend anything. But there might be more to come, so we'll see.
