Kavanaugh Hearing

    How does being up for SCOTUS involve the FBI? They do background checks on nominees, that is it. If there is an accusation of a local crime during a background investigation, they turn over that information to the law enforcement agency that has jurisdiction, they don’t do the investigation themselves. This accusation would be turned of to local law enforcement if it happened in May or June.

    The only proper way for the accuser to get a law enforcement investigation of her accusations is to file a criminal complaint in Maryland. There is nothing preventing her from doing that as the statue of limitations doesn’t exist for this accusation.

    Find me the law that prevents the FBI from investigating the allegation.

    So you didnt attend UF in last 10 years?Now I'm just asking to know. I swear I read you saying you weren't old enough to vote in 96'. So you had to be at UF in the last 15, 10 was a guess.

    If you think the committee is going to be openly hostile toward this woman on TV, you don't seem to know much about politics. I am not saying she might not be telling the truth, but it's getting weirder by the day with more delays and demands now. Either she is irrational or being poorly advised by someone if she thinks she is going to dictate how the testimony happens. If she doesn't agree to go in there soon, the committee will move on and vote and say she was afforded her chance to speak. They get let off the hook. If she does want them to listen to her and get justice or whatever, it's on their terms.

    Show me a law/US Code that does allows the FBI to conduct investigations into local crimes outside of their jurisdiction when it deals with SCOTUS nominees.

    Well, if you don't know, that's kind of a big problem for any accusation you're making. I attended UF Law within the past 10 years. ;)

    If the FBI is the organization that investigates his background (i.e., vets him) and this is something that is part of his background, then . . . .

    So I was right LOL, 10 years is close enough for an accusation. You give Ford credit for telling a therapist about an assault(without naming names) 6 years ago.

    And it's up to them as to whether to take it further than noting the letter in the file and maybe making some inquiries. She can't demand an FBI investigation.

    Kavanaugh’s support among women was already around 30%, they railroad her in women’s eyes and they hand the house to the dems, and maybe the senate. So as I said around my first post in this thread, no win situation now.
    They will find a compromise, she will testify with some conditions (limited time, limited hostile questions etc) and eventually Kavanaugh will get his vote.
    I do agree she hurts her cause by overplaying her hand though. Of course she could just say she isn’t testifying, release a statement about how wrongly she thinks she was treated and call it a day.
    We will see.

    I give Ford credit for describing her allegation six years before making it public and having it fit Kavanaugh to a T. Her allegation was a whole lot more narrow than a 10 year period. ;)

    She can demand one. They don't have to listen, though.

    Judge, the witness, doesn't appear to want to testify but is not on her side of the story at all. These Senators make Teddy look like an amateur when it comes to the perfected art of borking in DC.

    The answer to “then.......” is the information is turned over to the law enforcement agency that has jurisdiction of the case. If I was going in for a White House position and during my FBI background investigation, it was revealed I may have committed sexual assault at Camp Pendleton, the FBI would turn that over to NCIS to investigate. They would not do it themselves.

    Chucky Schumer can ask for it, but the FBI doesn’t have to do it. They have stated they have updated his file and that is the only action they are going to take.

    The only way this investigation happens is if Dr. Baker makes a criminal complaint in Maryland.

    Again, please show me a Law or US Code that allows the FBI to investigate accusations of a local crime a SCOTUS nominees accused of committing. You’re a lawyer, it should be easy to find.

    The FBI investigated the Anita Hill accusatoins before she testifed.

    So lets say there is an FBI investigation, what is it that they will investigate?

    The can interview her, they can interview BK and MJ. What else? There is no physical evidence, no other named witnesses. The investigation shouldn't take but a day. Send an agent to each of them and a day to compare notes.

    The FBI won't be investigating for the sake of criminal charges. They're investigating for the sake of vetting Kavanaugh. If it's for criminal charges, it would have to be the local authorities. However, nothing (other than the statute of limitations) is currently preventing the state or local authorities from investigating her charges. She doesn't need to make a criminal complaint. That whole argument is a load of bull.

    You willing to face death threats over your accusation, become a national name, and tell your story in front of the Senate even though you know it's a lie? If yes, then you know what this woman is going through, assuming she is lying. But what if she's telling the truth?

    Interview those three. Interview others if she can come up with other names. Interview the husband. Review any evidence that might corroborate her account or Kavanaugh's. Like you said, there's not much investigating that can be done. It's not much of a delay.
